If\u00f8lge norsk lov har en person som arbeider i Norge bare rett til barnetrygd hvis barnet bor sammen med ham eller henne. Norske myndigheter unders\u00f8ker ikke hvorvidt barn som bor utenlands faktisk er fors\u00f8rget av forelderen som bor i Norge n\u00e5r foreldrene ikke bor sammen. Dette mener ESA er i strid med E\u00d8S-reglene, som gir en rettighet til \u00e5 motta barnetrygd hvis barnet faktisk fors\u00f8rges av foreldren, uavhengig av om foreldrene bor sammen eller ikke.<\/p>\n\n
E\u00d8S-avtalen koordinerer medlemsstatenes trygdesystemer i grenseoverskridene saker.
