Den er ikke i samsvar med de forpliktelser Norge har p\u00e5tatt seg ved gjennomf\u00f8ringen av tjenestedirektivet. Form\u00e5let med dette direktivet er at tjenestesektoren i det indre marked skal fungere bedre.<\/p>
Det er ingenting i veien for at Norge kan etablere kontrollordninger innenfor byggsektoren, men plan- og bygningslovens bestemmelser p\u00e5 dette omr\u00e5det er mer restriktive enn det E\u00d8S-retten tillater. Norge tar heller ikke hensyn til at utenlandske tjenesteytere allerede er underlagt kontrollordninger i den medlemsstaten hvor de er etablert.<\/p>
ESA har derfor konkludert med at de norske reglene p\u00e5 dette omr\u00e5det ikke er i samsvar med tjenestedirektivet og sendte idag et brev til Norge i form av en s\u00e5kalt grunngitt uttalelse. Dette er trinn to i den formelle traktatsbruddsprosedyren i E\u00d8S. Hvis Norge ikke tar skritt for \u00e5 f\u00f8lge opp sine E\u00d8S-forpliktelser innen to m\u00e5neder, kan ESA beslutte \u00e5 bringe saken inn for EFTA-domstolen.<\/p>
